According to the Texas Civil Practice & Remedies Code section, 16.003 the statute of limitations for personal injury cases in Texas is two years. This means that you have two years from the date of your injury to file a claim or you will lose your right to pursue compensation. While Texas does recognize some exceptions to this two-year rule, it is best to file your personal injury claim as soon as possible. Recoverable Damages in a Personal Injury Case

There are three types of damages available for injury victims to pursue in a personal injury case. These damages are economic, non-economic, and punitive damages. The first two damages, also called general and special damages can be grouped together as “compensatory damages.” Compensatory damages are the damages responsible for compensating the injured party for as many losses as possible. These losses can include:

  • Pain and suffering
