How Brain Injuries Affect Health & Daily Life
A traumatic brain injury can range from a mild concussion involving a brief change in consciousness to a severe condition involving extended unconsciousness or amnesia. Even an injury initially described as mild can disrupt memory, concentration, sleep, mood, work, and daily routines. Severe cases may require extensive rehabilitation or long-term assistance.
Common causes of brain injuries include:
- Falls that cause the head to strike a floor, object, or other surface.
- Motor vehicle collisions involving cars, commercial trucks, motorcycles, pedestrians, or cyclists.
- Assaults involving direct blows or forceful movement of the head.
- Strikes to the head during sports or recreational activities.
Atlanta families may encounter several levels of emergency and rehabilitation care. Grady Memorial Hospital operates the Marcus Trauma Center and an Acute Inpatient Rehabilitation Unit that treats patients with brain injuries. Shepherd Center focuses on brain and spinal cord injury rehabilitation and is designated as a Traumatic Brain Injury Model System. We have no referral arrangement with either provider.
Medical records alone may not capture the full consequences of a catastrophic injury. Building a case may also require evidence of changes in daily activities, employment, relationships, future care needs, and the injured person’s ability to live independently.
Damages & Deadlines Under Georgia Law
Recoverable damages depend on the evidence and circumstances of each case. They may include economic losses, pain and suffering, and documented long-term care needs. The responsible parties, available insurance, and degree of fault can also affect the value.
Several Georgia rules can shape a brain injury case:
- Two-year filing period: O.C.G.A. § 9-3-33 generally gives an injured person two years from the injury date to file a personal injury lawsuit arising from an accident such as a crash or fall.
- Claims involving minors: O.C.G.A. § 9-3-90 generally tolls the filing period until age 18 when the injured person was a minor, often allowing filing until the 20th birthday. Exceptions may change that calculation.
- Government claims: Ante-litem notice, meaning formal notice before a lawsuit, may be required within six months for a municipal claim. Claims involving a county or the State of Georgia commonly carry a 12-month notice period.
- Comparative negligence: An injured person can generally recover damages when less than 50 percent at fault, but the award is reduced by that person’s percentage of responsibility.
For injuries occurring on or after April 21, 2025, Georgia law allows juries to weigh both the amount a provider billed and the amount actually paid when determining the reasonable value of recoverable medical damages. Punitive damages are generally capped at $250,000 in most injury lawsuits, although that cap doesn’t apply to product liability cases. Deadlines and available damages can vary based on the facts, parties, and legal theory involved.
How We Build & Pursue a Brain Injury Case
We begin by reviewing how the injury occurred, the available records, and the parties that may be legally responsible. A case may progress through evidence collection, medical-record review, insurance negotiations, and, when necessary, litigation. We track applicable Georgia deadlines and handle communications with insurance adjusters for our clients.
Evidence may include:
- Police reports, incident reports, photographs, and other accident records
- Statements and contact information from witnesses
- Hospital, physician, therapy, and rehabilitation documentation
- Pay records and employment information supporting lost-income claims
- Analysis from qualified professionals when the circumstances require it
We negotiate complex settlements based on the available evidence and take cases to trial when needed. A lawsuit involving an Atlanta accident commonly proceeds in the appropriate Georgia trial court serving the area, although venue depends on where the incident occurred, where defendants are located, and other case-specific facts. No fixed timeline applies to every insurance claim or lawsuit.
